Kasky v Nike is unlikely to go to court before late next year. The lawsuit, brought by environmental campaigner Marc Kasky over allegations that the sportswear company breached California state laws on ‘commercial speech’, was recently considered by the US Supreme Court. But the justices decided to rule on the case only after it had been heard by a court in California. According to Reclaim Democracy, a US-based NGO that supports Kasky, the case ‘should go to trial in San Francisco in the fall of 2004’.
